Terms of service

These Terms of Service constitute a legally binding agreement made between you, the user of this website (“you”) and CIM View Consulting, LLC (“CIM View” or “us”), concerning your access to and use of the www.cimview.com website, the api.cimview.com API, as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.  By using the Site or any materials produced by CimView linked from this site,  you agree to abide by these terms.  

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use our Site so that you understand which Terms apply. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.  This Agreement constitutes the entire agreement between the parties with respect to the subject matter thereof and supersedes all prior proposals, agreements, negotiations, correspondence and all other communications, no modification or waiver of any provision hereof shall be effective unless made in writing signed by both CIM View and Subscriber.

The contents of the Site include summaries of events and and other information and data concerning the Public Utility Commission of Texas (“PUC”) and the Electric Reliability Council of Texas (“ERCOT”), as selected and determined by CIM View in its sole discretion.  Under no circumstance is a user permitted to disseminate or republish information from the Site to third parties.  CIM View, or the trademark or copyright owners otherwise identified, are the trademark and copyright owners of all text and content contained in the Site.  Copying, publishing or redistributing any Site contents in any media or format without the written consent of CIM View is strictly prohibited.  The content in the Site may contain links or references to third party sites. CIM View is not responsible or liable for the content of those sites and your access to and use of those sites is at your own risk. Any links are provided for convenience only, and do not indicate any endorsement or recommendation by us.

The Site and the contents therein are provided only for information purposes, and are not comprehensive or advisory in nature. This Agreement will be governed by the internal laws of the State of Texas, without regard to conflicts of laws.  Any lawsuit or claim by either party arising out, relating to, or to interpret this Agreement shall be brought exclusively in the court located in Austin, Texas.  Subscriber submits to the venue and personal jurisdiction of said courts.
